REGARDING OBLIGATIONS

ŞTİ. hereby shares its commitment to act in accordance with the Law on the Protection of Personal Data No. 6698 ("KVKK Law") and the secondary legislation related thereto, through this Clarification Text. Our Company considers it an obligation to provide the necessary information to data owners, within the scope of Article 10 of the said Law and the Communiqué published by the Personal Data Protection Board in the Official Gazette numbered 30356 on March 10, 2018.

1. CONCEPT OF PERSONAL DATA

Within the framework of the KVKK Law, personal data encompasses all kinds of information belonging to an identified or identifiable real person. In line with this definition, information such as name and surname, residence address, telephone number, electronic mail address, date of birth, and IP address are considered personal data. In addition, the Law defines race, ethnic origin, political opinion, religious belief, health status, sexual life, biometric and genetic data, and criminal conviction records as "special categories of personal data" and foresees a higher level of protection for them. Anonymous data that cannot be associated with a person are excluded from this definition.

2. PROCESSING OF PERSONAL DATA

The KVKK Law evaluates any operation such as obtaining, recording, archiving, storing, modifying, restructuring, disclosing, transferring to others, taking over, making accessible, classifying, or preventing the use of data through automatic or partially automatic means, as "processing of personal data".

4. COLLECTION OF PERSONAL DATA AND LEGAL BASIS

Your personal data is collected orally, in writing, or digitally through our website www.findikotesi.com and mobile platform, electronic mail and SMS communication, commercial contract processes, and direct customer relationship channels, via browser cookies, filled forms, and similar electronic tools.

The legal basis for the processing of your personal data consists of the conditions of explicit consent, necessity for the performance of a contract, and fulfillment of legal obligations, as regulated in Article 5 of the KVKK Law No. 6698. Our Company processes the data it collects only within the scope of the purposes specified in this Clarification Text and retains it for legal retention periods.

5. YOUR RIGHTS AS A DATA SUBJECT

As personal data owners, you have the following rights within the scope of Article 11 of the KVKK Law No. 6698:

a) To inquire whether your personal data is being processed and to obtain detailed information if it is being processed,

b) To learn the purpose of the processing and to check whether the data is used in accordance with this purpose,

c) To access information regarding data transfers domestically or abroad,

d) To request the correction of incomplete or incorrectly processed data,

e) To request the erasure or destruction of your data if the conditions stipulated in Article 7 of the KVKK Law are met,

f) To request that corrections or erasures made be notified to third parties,

g) To object to a decision established against you based solely on the results of analyses carried out through automated systems,

h) To demand compensation for damages incurred due to unlawful data processing.

Your application will be concluded free of charge within 30 (thirty) days at the latest, depending on its nature. This tariff may be applied if a fee is determined by the Personal Data Protection Board.
